The Kentucky Attorney General says challengers dismissed the suit against a new vaping law

A federal lawsuit challenging Kentucky’s vaping law has been dropped. WNIN’s John Gibson reports:

After a months-long court battle, the challengers to the law voluntarily dismissed the suit before the U.S. Court of Appeals Sixth Circuit.

The commonwealth’s Attorney General Russell Coleman called it a major victory to protect Kentuckians’ health and safety.

The dismissal effectively ends the challenge to House Bill 11, which established new guidelines and enforcement relating to vapor products.

The bill says manufacturers, wholesalers, and retailers can sell only “authorized” vape products.

It also prohibits retailers from selling “authorized” vape products to those under the age of 21.

Coleman opposed the plaintiffs’ request, in part because they sued to continue selling products that are illegal under federal law.

The Sixth Circuit unanimously agreed with the Attorney General.

The Kentucky General Assembly passed the vaping legislation in April 2024. It took effect in January.
