A special prosecutor has asked a judge to deny a motion to dismiss charges against Warrick County commissioners. WNIN’s John Gibson has details:
The three commissioners asked a judge last month to remove the special prosecutor overseeing their criminal cases and to dismiss the charges.
The commissioners say the special prosecutor overstepped her legal authority when she charged them.
The Evansville Courier and Press reports Prosecutor Samantha Hurst filed her response last week, asking Warrick County Superior Court to deny the motion filed by commissioners Dan Saylor, Robert Johnson and Terry Phillippe.
The three commissioners were charged in February with official misconduct and false informing after a state police investigation of Warrick County's animal control and health departments.
Phillippe also faces a charge of perjury.
Challengers defeated Saylor and Johnson in the May Republican primary.
Phillippe is not running for re-election.
