Smoking ban future uncertain

Members of Evansville's City Council say they're still considering what to do next about the city’s rejected smoking ban.

The Indiana Supreme Court threw out the city's smoking ban ordinance two weeks ago in a 3-2 decision. The state’s high court ruled the city couldn't exempt the Tropicana casino from the smoking ban that included all other businesses, including bars and private clubs.

Coucilman Jonathan Weaver tells WNIN News that he will not support another exemption. Councilman Dan Adams says he would like to find a “third way” and says perhaps Mayor Winnecke could lead the way. And Councilman Al Lindsey tells us it’s a “dead issue” and that economics should decide the right choices for local businesses.

Smokefree Communities director Julie Phillips is urging the council to include the casino in a new ban. The Evansville Courier and Press reports that she told the council a full ban would address the Supreme Court's ruling that exempting the casino was wrong.
